New use of force laws in the UK!
« on: February 10, 2005, 08:55:10 PM »

Hi Guys

British homeowners are finally allowed to kill or seriously injure intruders without facing prosecution, as long as they can justify their actions were in alignment with newly defined guidelines on the use of force continuum.

These guidelines state that house residents can use weapons such as knives and guns against a home invasion, but cannot hurt someone who is already unconscious or those who premeditatedly set a trap for their intruder.

These laws have been changed due to the rise in burglaries and home invasions in the UK.   The director of public prosecutions Ken Macdonald said, “As long as citizens do not step over the line into retribution or revenge, it would be very difficult to perceive any level of violence that would not be regarded as reasonable force when someone has broken in to your home.”

This is great news for all of us that reside in the UK.  Hopefully criminals will think twice before breaking into other people’s homes.

Ciao

Joe, there are no new laws.  They came into force in 1967.  All that has happened is that they have been clarified, as there is a common misconception that a person cannot defend him/herself without getting into legal difficulties.

Hi Bri

Thanks for clearing that up.  The way that the news reported this issue, it had seemed to be a new implementation within British law.  Thank god it’s cleared up though, because I have had long discussions even with police officers that didn’t really know their rights when it came to this subject.

They won't.  The Law is a bizzarre mess of non-sensical and contradictory bull shit.  The law makers have tried to get it all totally "exact", leaving little room for common sense application.  Then, every time a law comes out, the loop-holes they missed get exposed by the criminals - hence the phrase "getting off on a technicality".

And police training is shite anyway.  We spend hours sitting in a semi circle talking about issues ("how do you feel about this?  How do you nfeel about that?") but very little "This is how it is".

Back to topic - we do have a reight to self defence in the UK.  The cases of "innocent" people being prosecuted for defending themselves that I have heard of rarely stand up to independent scrutiny, as those people are not quite as innocent as initially reported.

Yup, the Law is an Ass.  But it isn't quite as big an Ass with self defence as the media would have you believe.  Not quite!   ;D
